§1. General

All deliveries and services are carried out exclusively on the basis of the following General Terms and Conditions (GTC) in the version valid at the time of the order. Deviating conditions of the customer are not recognized unless Autotuningfiles has previously agreed in writing.

All information in the database without guarantee. Deviations of 10-15% are normal depending on the age of the vehicle.

§ 2 Conclusion of contract

The customer’s order represents an offer of autotuning files for the conclusion of a purchase contract. If the customer places an order with Autotuningfiles, Autotuningfiles will immediately send the customer an order confirmation by e-mail. This does not constitute acceptance of the offer.

A sales contract is only concluded when Autotuningfiles sends the ordered goods to the customer. Credits are valid for 4 weeks!

§ 3 cancellation policy

If the customer is a consumer, he can revoke his contractual declaration within 14 days without giving reasons in text form (e.g. letter, e-mail, fax) or by returning the item.

The period begins at the earliest one day after receipt of a cancellation instruction in text form to be communicated separately, but not before the day the goods are received by the customer. The timely dispatch of the cancellation or the item is sufficient to meet the cancellation deadline.

The right of withdrawal does not exist in the exceptional cases regulated by law, in particular

– in contracts for the delivery of goods that are made to customer specifications or

– in the case of goods that are clearly tailored to the personal needs of the customer or

– in the case of goods which, due to their nature, are not suitable for return.

In the event of an effective revocation, the services received by both parties must be returned and any benefits (e.g. interest) surrendered. If the customer cannot return the goods in whole or in part or can only return them in a deteriorated condition, Autotuningfiles can demand compensation in this respect. This does not apply if the deterioration is solely due to the inspection as in a shop or the intended use without further use of the item. In addition, the customer can avoid the obligation to pay compensation by not using the item as if it were his property and refraining from anything that would impair its value.

Items that can be shipped by parcel are to be returned by the customer at the expense and risk of Autotuningfiles.

Deviating from this, the customer has to bear the costs of the return if the delivered goods correspond to those ordered and if the price of the item to be returned does not exceed an amount of EUR 40.00 or if the customer still has a higher price of the item at the time of the cancellation has not provided the consideration or a contractually agreed partial payment. Otherwise, the return for the customer is free of charge. Items that cannot be shipped by parcel will be picked up from the customer.

§ 4 Delivery

Unless otherwise agreed, delivery is made from the Autotuningfiles warehouse to the delivery address specified by the customer. Information about the delivery period is non-binding, unless the delivery date has been promised as an exception.

If Autotuningfiles is not able to deliver the ordered goods through no fault of its own because the supplier of Autotuningfiles does not fulfill its contractual obligations, Autotuningfiles is entitled to withdraw from the customer. In this case, the customer will be informed immediately that the ordered product is not available. The legal rights of the customer remain unaffected.

If delivery to the customer is not possible because the delivered goods do not fit through the front door, front door or stairwell of the customer or because the customer cannot be found at the delivery address provided by him, although the customer was informed of the delivery time within a reasonable period of time , the customer bears the costs for the unsuccessful delivery.

§ 5 Price

The prices given are final prices and include the statutory sales tax. In addition, the customer has to bear the costs for packaging and shipping.

§ 6 Payment, Due Date and Default

The customer can pay the purchase price plus Pay the shipping costs in advance or cash on delivery.

Payment in advance is to be made within 7 days of receipt of the order confirmation. The time of receipt of money at Autotuningfiles is decisive.

§ 7 Retention of title

The ordered goods remain the property of Autotuningfiles until full payment has been made. Before the transfer of ownership, pledging, transfer of ownership, processing or redesign is not permitted without the express consent of Autotuningfiles.

§ 8 StVZO

After the software optimization, the customer undertakes to register his car/truck in accordance with the StVZO. The same applies to active sound systems.

Autotuning files do not offer expert opinions

§ 9 Applicable Law – Place of Jurisdiction

This contract is subject to German law.

If the buyer is a merchant, the place of jurisdiction is Munich.

§ 10 Guarantee

Autotuningfiles expressly only gives a warranty on installed parts. No liability for the engine or consequential damage. An engine warranty can be taken out as an option because the factory warranty can expire.

Attention: Software changes of any kind and already installed tuning parts, motorsport items + sound boosters are non-returnable.
